Privacy Policy

Yankel-Tech Ltd., an Israeli registered limited liability company (“we“, “us” or “our“, or “Yankel Tech“) regards your privacy seriously. These terms will help you understand what information we collect about you and your family and how we may use such information, including information that can be used, alone or together with other information, to personally identify an individual (“Personal Information“), all as related to the services provided to you within the “FamilyKeeper” app (the “App“).

1.     Consent 

By downloading our App and approving our Terms of Use (located at: http://www.familykeeper.co/policy/terms-of-use-fk/) and this Privacy Policy, you expressly consent to the terms of such Terms of Use and this Privacy Policy. Please read these documents carefully before using our App. If you do not agree to any of the terms hereof, please do not download the App, and if downloaded, remove or disable the App. 

Note that certain features within the App require the affirmative consent (opt-in) of your family members in connection with whom you seek to use the App (for purposes hereof, “Minor(s)“). Accordingly, be advised that without such Minors’ affirmative consent to the terms of this Privacy Policy, those parts of the App which do or may collect Personal Information concerning the Minor will not be available. 

2.     Purpose of the App

THE APP WAS DESIGNED AS A SERVICE FOR PARENTS AND OTHER LEGAL CUSTODIANS TO SUPERVISE THE ACTIVITIES, INCLUDING INTERNET USE AND ONLINE COMMUNICATIONS, OF THE MINORS IN THEIR CARE. YOU, AS THE USER OF THE APP, SHALL BE RESPONSIBLE TO ENSURE THAT THE MINORS IN YOUR CONTROL HAVE BEEN DULY NOTIFIED OF THE PURPOSES OF THIS APP AND THE PERSONAL INFORMATION THAT MAY BE COLLECTED BY THE APP. THIS APP IS NOT INTENDED TO REPLACE PARENTAL SUPERVISION AND VIGILANCE, BUT RATHER IS INTENDED TO ASSIST THE PARENTS IN GUIDING THE MINORS IN THEIR CARE IN THE PROPER AND RESPONSIBLE USE OF MOBILE DEVICES AND OTHER ONLINE ACTIVITIES. 

BY USING THE APP YOU ALSO REPRESENT AND AGREE THAT YOU WILL COMPLY WITH ALL APPLICABLE LAWS, RULES AND REGULATIONS IN CONNECTION WITH YOUR USE OF THE APP, YOU WILL NOTIFY THE MINORS OF THE USE OF THEIR PERSONAL INFORMATION COLLECTED BY YOU THROUGH THE APP, WILL OBTAIN THEIR CONSENT, AND USE SUCH PERSONAL INFORMATION FOR LAWFUL AND LEGITIMATE PURPOSES ONLY.

Given the fact that the App is a parental tool, our services are not intended to be provided to children, and we do not knowingly collect information from children under the age of 13. If you, as a parent or legal custodian, become aware that a minor under your supervision has provided us information without your consent, or otherwise has provided us with any information that you would like to have removed, please contact us at: support@familykeeper.co.

3.     What information we collect

When you choose to join our services via the App (and as and when the App is downloaded onto the Minor’s mobile device), we will ask you to provide information some of which may be Personal Information, such as a name, phone number, and e-mail address. On completing the registration process, you will be asked to create your own password, which will enable you to privately enter your created account. Please refer to our Terms of Use concerning your responsibility with respect to maintaining the confidentiality of your account.

As a parent or a legal custodian, when you set up an account, you will also be asked to provide information about the Minors for which you wish to use this App, including such Personal Information as their name, phone number, e-mail address, and date of birth (which we use to help us configure the product based on the age of the Minor), and you will also be asked to create a username for each Minor. Note that while provision of a Minor’s phone number is required in order to use the services offered by the App, you do not have to provide any additional Personal Information of the Minor, can use pseudonyms instead of actual names, etc. For example, if you do not provide the Minor’s date of birth, the App will use generic configurations. On completing the process, you will be given a PIN code. Such PIN code is to be entered into the App as and when downloaded onto your Minor’s device, which will thereafter synchronize your and the Minor’s mobile devices. Note that the account will only operate and function on the original devices to which it was initially downloaded.  

As part of the services featured by the App, you, as a parent or the legal custodian, will have visibility to the following information concerning the Minor’s mobile device: 

(i)            Incoming and outgoing calls; 

(ii)            SMS, MMS and emails (including the entire content of conversations); 

(iii)           The address book and name associated with calls, SMS and/or MMS; 

(iv)           Website use and search terms used by the Minor; 

(v)            Downloads and uses, videos watched, social networks (such as WhatsApp, Facebook, Instagram etc.), notifications, messages and content, as well as incoming and outgoing social network app calls; 

(vi)           Dependent on mobile device settings, the mobile device’s geolocation; 

(vii)          Alerts and notifications (such as app updates, downloads, ads, and more); and 

(viii)         Remotely locking the Minor’s mobile device.

You as the parent and the Minor accept that without affirmatively approving the above, by opting-in into the App at the time of download onto the respective mobile device, the above service and information visibility will not be enabledYou also understand and agree that, as stated in the section titled “Purpose of the App”, you are responsible for obtaining informed consents from each Minor for which you use this App and that you will comply with all relevant legislation, including data protection legislation, in connection with your use of Minor’s Personal Information. Please note that the App will always announce its presence to the Minor, and that the Minor will always be aware of the information accessible to the parent or a legal custodian.

4.     How we use the information that’s collected

YankelTech uses the Personal Information provided by you upon creation of your account in order to provide our services to you, including administrative and technical support, and any communications as may be required for the provision of services. We may also provide you with marketing offers, subject to your consent and any applicable laws. We may also use or share non-personal information (i.e. information which does not enable identification of an individual user) for the purpose of providing and improving our services, conducting aggregate statistics, business and marketing analysis, and enhancing user experience with our App. 

Any Personal Information collected from the Minor’s mobile device is processed by YankelTech solely on your behalf, subject to the options selected by you using our Settings menu, and may be used to:

·         Provide you with a report on the Minor’s use of the mobile device, such as, for example, to alert you of any misuse of the Minor’s mobile device, or to enable you to view information related to the Minor’s SMS/MMS conversation. Note, however, that if the SMS/MMS service provider is a third party, we do not have the ability to block such SMS/MMS exchange. 

·         Locate the Minor’s mobile device. By default, location supervision services are turned off. As a parent or legal custodian you will be required to separately opt-in and turn on the location supervision service. Please note that monitoring location and the use of any record of such monitoring may be restricted by local laws applicable to you. We recommend that you inquire with local authorities before activating this feature. In any event, note that we will only track the Minor’s mobile device and display the device’s GPS location on a map at your request. We will not store the event or retain a history of the mobile device’s location.

Note that any Personal Information collected from the Minor’s mobile device is processed by us solely on your behalf, and only to the extent necessary to provide you with services enabled by the App and subject to your choice of the specific configurations within the App. 

5.     How we share your information

The Personal Information collected in connection with your account is maintained with strict confidentiality, and may be shared with third parties solely for the following uses:

·         to comply with applicable laws, regulations, legal processes or governmental requests; 

·         to enforce our policies (including our ToU and this Privacy Policy), including investigations of potential violations thereof; 

·         in case of merger, acquisition or bankruptcy, as described in Section 12 of this Privacy Policy;

·         on a limited basis, to our business partners and service providers, solely in connection with provision of our services to you and subject to confidentiality undertakings from their end;

·         to investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; 

·         to establish or exercise our rights to defend against legal claims; or 

·         to prevent harm to our rights, property or safety, our users, yourself or any third party.

We may store and process your Personal Information in other countries, including countries that may have less protective data protection laws than the country in which you are located (including the European Union), but will do so solely for the purposes specified in this Privacy Policy and in accordance with applicable laws. 

We will never sell, rent, or otherwise provide your Personal Information or the Minor’s Personal Information to any third parties for marketing purposes.

6.     Opting out

If you opt-out of providing the information required to be submitted for the creation of your account, you may not be able to use the App and the services offered by the App. However, you are advised that you may opt-out of all or any feature within the services offered by the App (such as SMS/MMS monitoring, location services, etc.) by re-configuring the App. To do so, simply enter the “Settings” menu within the App and enter your desired configuration. 

7.     Access to information 

You have the right to request access to information we have collected about you. You can do this by contacting us at support@familykeeper.co. We will make sure to provide you with a copy of the data we have processed about you. In order to comply with your request, we may ask you to verify your identity. We will fulfil your request by sending you an electronic copy of the information. For any subsequent access request, we may charge you with an administrative fee.

8.     Information correction, retention & deletion

If you believe that the Personal Information we have about you is incorrect or missing, you are welcome to contact us so we can update it and keep your data accurate. Any Personal Information collected or processed by us will be retained only for as long as needed for the purposes specified in Sections 4 and 5. If at any point you would like us to delete any Personal Information we have about you, please contact us at the e-mail address set forth in Section 7 above. You may also delete your account entirely through the App. Deleting your account will erase all of your Personal Information, including from our servers.              

9.     How we protect your information

The security of your Personal Information is important to us. We, therefore, use up-to-date cryptography technology to secure your Personal Information (such as HTTPS-Hyper Text Transfer Protocol Over SSL (Secure Socket Layer), RSS Encryption, etc.), including the use of appropriate administrative, physical and technical safeguards, to protect information in connection with your account. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security or confidentiality. 

10.   Use of Cookies

We may use session ID cookies and/or persistent cookies or functionally equivalent technology (collectively referred to as “Cookies”) for such purposes as, for example, to personalize your user experience and help you navigate seamlessly through the App. Cookies are stored on your local device, and not on the App’s servers. If you reject cookies, you may still use our App, but your ability to use some areas of our App may be limited. 

11.   Interaction with third party products 

This Privacy Policy does not apply to the practices of companies that we do not own or control or to individuals whom we do not employ or manage, and any use of such third party services is at your own risk and subject to such third parties’ respective privacy policies and terms of use. 

12.   Merger, Sale or Bankruptcy 

In the event that we are acquired by or merged with a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer or assign information, including Personal Information, in connection with the foregoing events. In the event of the above, our affiliated companies or acquiring company will assume the rights and obligations as described in this Privacy Policy.

14.   Modifications to the Privacy Policy 

We reserve the right, at our discretion, to revise or update this Privacy Policy at any time. Any material change will be effective upon your consent to such changes. Note that by not approving such changes you may not be able to keep using the App. The last revision will be reflected in the “Last Updated” heading. Please make sure to review our Privacy Policy periodically.
